House Rules for Penthouse

By booking this space, guests accept and agree to abide by the following house rules. Violating these rules could result in cancellation of your stay, as well as additional damages up to the amount of security deposit. Please respect our space and your fellow guests!

ENTRY CODE AGREEMENT

Agreement for the key code user for 688 and 678 Nebraska St.

I have received the key code for the entrance to 678/688 Nebraska St. I agree not to share this code with anyone no matter what. If I in fact leak this code to anyone after signing this document, I agree to vacate the apartment and move all my belongings out within 24 hours. I also agree to pay any and all damages resulting from my divulging or leaking said code. I also agree never to enter the above stated address without invitation by the owner.

MIXED USE BUILDING REQUIREMENTS

We have several commercial tenants sharing the building in addition to our residential tenants. In order to accommodate them and provide a greater level of comfort and security, we ask that you observe the following rules:

1. All authorized visitors are to use only the front entrance coming as well as leaving. All visitors must be accompanied at all times by the tenant. Anyone found roaming the building without escort will be asked to leave immediately.

2. The rear parking lot is restricted and/or off limits to anyone other than tenants with a designated parking spot or dumping trash.

3. 24 hour surveillance cameras have been installed to provide a greater level of security for all tenants and their property. This also allows us to better monitor the recycling and trash facility. Note: just a reminder that all trash must be sealed in plastic bags tied or bound securely. No loose garbage is to be placed in or around the trash area and no garbage is to be put into a can without a liner. Please recycle. There are guides to which materials may be recycled in each room.

4. The entire building and parking lot is a non smoking zone. No mechanical work on vehicles is to be performed in this area either. Given common quarters we ask that you respect and observe all of these rules as a gesture of common courtesy to your neighbors.

NO SMOKING

Due to city ordinances regarding mixed use commercial residential buildings all persons living in the building or guests thereof are prohibited from smoking in tis building or on any of its adjoining property… you are allowed to smoke inside your vehicle or on the surrounding public sidewalk.

HOUSE RULES FOR PENTHOUSE APARTMENT

1. No smoking, drugs, or sexual activity permitted.

2. No visitors.

3. No pets of any kind.

4. No shoes from outside are permitted in the carpeted area.

5. No burning candles or incense.

6. Clean all messes you make in the common areas, or you will be charged for maid service.

7. Please keep your room clean and vacuumed.

8. If the carpet in your room or anywhere in the space becomes soiled please notify the

manager so it can be professionally cleaned.

9. You are all responsible adults, so it is up to you to take turns cleaning this space, dusting,

vacuuming, moping and garbage removal.

10. Please close the dryer door after use or the light will stay on.

11. Refrigeration and dry goods space is set up in the kitchen area. Be sure to maintain and

remove all dry goods.

12. For security reasons be sure all access doors are locked when leaving the building.

13. Please keep all noise to a minimum and respect the schedules of other tenants.

14. Upon terminating your tenancy here you must give a 30 day notice or you will forfeit your

deposit (long term guests only).

15. Rent is due on the first of every month (long term guests only). If your rent is late you will be

charged a late fee of $50.

16. You are allotted only one parking spot in the rear, designated by your room number). No

guests are to be allowed to park there.

17. No mechanical work is to be performed on vehicles in the parking area.

18. Failure to comply with all of these rules may result in eviction.

SPECIAL CIRCUMSTANCES SUPPLEMENT

Tenants and visitors to this property shall not engage in or have any incident domestic or otherwise causing complaint from either the other tenants or management personnel.

These incidents include but are not limited to: physical or verbal disputes with anyone, involvement with the police or having for any reason the police called to this property (unless of course in an emergency situation), damage to any part of 678/688 Nebraska St. or any of the attached property, any excessive traffic (visitors) or vehicles (to be determined by management) and also shall refrain from involvement with or use of an controlled substance of any kind.

The undersigned also agrees to comply with all rules and regulations set forth in the signed standard rental contract.

Any violation of the afore mentioned or having any other incident deemed by the management to be unacceptable behavior will result in forfeiture of the security deposit and immediate dissolution of the rental agreement. Alike the undersigned agrees to vacate the premises of 678’688 Nebraska St within 24 hours of being notified, after which the undersigned also agrees never to return to this property or attempt to enter premises without prior permission from management.

GATE OPERATORS (REMOTES)

It is the responsibility of the tenant to take care of his/her remote. Your remote must be returned in working condition. Replacement of this remote will cost you $50. Under no circumstances are tenants to tamper with, open or alter the remote in any way. Doing so will result in the loss of your deposit and you will be charged an additional $300 maintenance fee (for us to recode the gate and all other remotes for security reasons). If your battery goes dead please notify us and we will change it.

Tenants are not allowed to buy and program their own remote for security reasons. Also should you have trouble operating the gate immediately call Karla at (Phone number hidden by Airbnb) to address this problem. Under no circumstances should anyone ever force the gate open.

Doing so will result in loss of your remote and loss of your parking privileges in the rear lot and you will be charged a $300 or more service fee for damage to the gate as it throws it our of tolerance and has to be readjusted and the chain re-railed, compounding any problem.

MOLD NOTIFICATION

Landlord endeavors to maintain the highest quality environment for the Tenant. Therefore, know that the Landlord has inspected the unit prior to lease and knows of no damp or wet building materials and knows of no mold or mildew contamination. Tenant is hereby notified that mold, however, can grow if the premises are not properly maintained or ventilated. If moisture is allowed to accumulate in the unit, it can cause mildew and mold to grow. It is important that Tenants regularly allow air to circulate in the apartment. It is also important that Tenants keep the interior of the unit clean and that they promptly notify the Landlord of any leaks, moisture problems, and/or mold growth.

Tenant agrees to maintain the property in a manner that prevents the occurrence of an infestation of mold or mildew. Tenant agrees to uphold this responsibility in part by complying with the following list of responsibilities:

1. Tenant agrees to keep the unit free of dirt and debris that can harbor mold.

2. Tenant agrees to immediately report to the Landlord any water intrusion, such as plumbing leaks, drips, or “sweating” pipes.

3. Tenant agrees to notify owner of overflows from bathroom, kitchen, or unit laundry facilities, especially in cases where the overflow may have permeated walls or cabinets.

4. Tenant agrees to report to the Landlord any significant mold growth on surfaces inside the premises.

5. Tenant agrees to allow the Landlord to enter the unit to inspect and make necessary repairs.

6. Tenant agrees to properly ventilate the bathroom while showering or bathing and to report to the Landlord any non-working fan.

7. Tenant agrees to use exhaust fans whenever cooking, dishwashing, or cleaning.

8. Tenant agrees to use all reasonable care to prevent outdoor water from penetrating into the interior of the unit.

9. Tenant agrees to clean and dry any visible moisture on windows, walls, and other surfaces, including personal property, as soon as reasonably possible. (Note: Mold can grow on damp surfaces

within 24 to 48 hours.)

10. Tenant agrees to notify the Landlord of any problems with any air conditioning or heating systems that are discovered by the Tenant.

11. Tenant agrees to indemnify and hold harmless the Landlord from any actions, claims,

losses, damages, and expenses, including, but not limited to, attorneys’ fees that the Landlord may sustain or incur as a result of the negligence of the Tenant or any guest, licensee, invitee or other person living in, occupying, or using the Property.

MAINTENANCE AND REPAIRS

Tenant will, at Tenant’s expense, and at all times maintain the

Property in a clean and sanitary manner including all furniture, furnishings, and appliances therein and will surrender the same upon termination of tenancy in the same condition received, except for normal wear and tear. Tenant will be responsible for all damages in about the Property caused by Tenant’s negligence and that of their family or invitees or guests or co-worker(s). Tenant will be responsible for checking and maintaining all smoke detectors. Tenant will immediately notify Landlord, in writing, of any problem, malfunction, or damage. Such notice will also be deemed permission to enter the Property to perform such maintenance or repairs in accordance with California Civil Code § 1954 unless specifically requested by Tenant. Landlord believes the Property is in a habitable condition until written notice to the contrary is received by Landlord. In the event Tenant hires or employs an independent contractor to complete repairs or improvements to the Property without written consent from Landlord, and the work and method of the contractor is found to be unsatisfactory and to have caused additional damage, Tenant will be responsible for the cost of redoing the work and to correct the damages.

Tenant acknowledges that the Property and the building from time to time may require renovations or repairs to keep them in good condition and that such work may result in temporary loss of use of portions of the building or Property and may inconvenience Tenant. Tenant agrees that any such loss will not constitute a reduction in housing services or otherwise warrant a reduction in rent. Further, subject to local law, Tenant agrees, upon demand of Landlord, to temporarily vacate the Property for a reasonable period, to allow for fumigation (or other methods) to control wood destroying pests or organisms, or other repairs to the Property. Tenant agrees to comply with all instructions and requirements necessary to prepare Property to accommodate pest control, fumigation or other work, including bagging or storage of food and medicine and removal of perishables and valuables. Tenant will only be entitled to a credit of Rent equal to the per diem Rent for the period of time Tenant is required to vacate Property.

Tenant further agrees to cooperate in any efforts undertaken by Landlord to rid the building and the Property of pests of any kind. Failure of Tenant to cooperate may be deemed an obstruction of the free use of property so as to interfere with the comfortable enjoyment of life or property thereby constituting a nuisance.

Attention All Tenants:

Recently there has been obvious smoking of tobacco and marijuana on this property, which is expressly prohibited on any portion of this property. We take fire hazards and threats to our shared air quality very seriously here. Smoking of any substance on this property is grounds for summary eviction, as is any other willful failure to abide by the written agreements now governing your tenancy in these units.

Please be advised that the next time there is any aroma of either tobacco or marijuana or any other smoke on this property, the units closest to the hazardous condition will be entered to investigate, without prior notice or warning. Failure to permit lawful property examination and protection will also be considered grounds for summary eviction.

It is only through abiding by our agreements that we can all enjoy peaceful coexistence together on this property. Thank you for your cooperation in maintaining a safe and secure environment for all the residents and business owners.
